Product and Service Guarantee
MBartist will stand behind the product quality of all printed products and guarantee customer satisfaction. We have outlined opportunities and controls for the purpose of addressing any customer concerns regarding products purchased from our website MBartist.com, and the websites of our affiliates. Claims for Quantity or Quality of Products
Any claims in respect of the quality or quantity deficiency of products supplied by MBartist must be received in writing within 7 days after the purchaser’s receipt of the product. Otherwise, the products are deemed to comply with the order and accepted by the purchaser.
Return Policy – Satisfaction Guaranteed
MBartist guarantees customer satisfaction. Returns meeting the claim criteria are eligible for credit or exchange. Customers may be asked to provide photo evidence of product or packaging condition for the purpose of filing insurance claims with our service provider.
Confirmation, Cancellation, and Changes of Orders
All orders are considered confirmed at the time they are placed. A confirmation of order receipt and confirmation of shipping of an order can be received via e-mail. Please register for a user account on MBartist.com or any affiliate website to receive this service, and to gain access to user order and email history records.
Cancellation of an order must be made in writing. If we receive a cancellation after the receipt of an order and the order has been shipped, the order must be returned intact at the cost of the purchaser before a credit for the order value will be issued.
Any quantity changes to an order after the time of placing shall be made in writing prior. It is best for additional quantity to be purchased as a new order.
Errors and Omissions
From time to time errors and omissions might be noticed in the MBartist catalogue and/or on the website(s) or our affiliates. Errors, omissions and discrepancies will be corrected on the MBartist.com website and shall supersede information found elsewhere.
Exports from Canada
The items illustrated on the MBartist.com website and the websites of our affiliates are available for distribution in Canada and the United States (as of September 2020). International shipments may be organized on an ad hoc basis by special request. Please email ALFRED@mbartist.com if you are an international customer seeking delivery service.
MBartist (Codesyne Inc.) cannot be held responsible for failure to fulfill a delivery commitment as a result of unexpected situations which are beyond our control. Examples of this include and not limited to are labor strikes, congestion at ports of entry into Canada or the United States of America, rail congestion, transportation delays due to congestion or weather, and changes in government acts and regulations. When we have implemented force majeure we will provide supporting information that has caused this delay.
Indemnification and Intellectual Property
Logos and artwork displayed on MBartist.com and affiliate websites do not imply endorsement of any kind. MBartist assumes that art works submitted by affiliates for production and distribution are in compliance with the relevant laws, governing copyright and trademark requirements. By submitting creations for purpose of sale the creator warrants that they have the legal right to the marks, symbols or design depicted in the artwork and shall indemnify and hold MBartist harmless in any action for infringement of a copyright or trademark as a result of the printing of the artwork. The creator shall furnish proof of right to use an intellectual property upon challenge by a third party.
Demand may on occasion exceed the supply that is readily available. Every reasonable effort will be made to resolve inventory delays and to fill orders in a timely manner under the circumstances in order to meet the aforementioned shipping times under the Production/Shipping Time section.
A purchase placed with MBartist shall be governed by the laws of the Dominion of Canada and the laws of the Province of Ontario, without regard to conflict of laws. Any disputes arising there of shall be resolved in a competent court of jurisdiction in the Province of Ontario. A purchaser not residing in the Province of Ontario is deemed to attorn to the exclusive jurisdiction of the courts in the Province of Ontario should any disputes arise once MBartist is in receipt of an order.
Limitations on Liability
Save in so far as defects in goods supplied by MBartist causing death or injury to the person, and/or damages to property giving rise to personal economic liability or otherwise, MBartist (Codesyne Inc.)’s liability shall not exceed, in aggregate, the amount paid by the purchaser for the goods supplied under a contract with MBartist (Codesyne Inc.) causing such damage. In no event shall MBartist be liable for any consequential damages or any other damages whatsoever, including without limitation, any loss of use, lost data, lost profits or lost opportunity incurred by the purchaser or a third party. The purchaser shall hold MBartist (Codeyne Inc.) harmless of all claims over and above the contract amount paid by the purchaser for the supply of goods causing such damages.
None of the foregoing shall limit consumers’ rights under the relevant laws.
Modes of Delivery
Our primary carrier is UPS, and as such, they are the last carrier to depart our facility each day. Delivery will be made by ground transportation. MBartist shall not be held responsible for carrier delays.
Prices, Freight and Taxes
List prices are quoted in US-dollars (USD). Shipping costs and applicable taxes are not included in list prices. Any duties on import for products shipping into the United States are paid by MBartist (the shipper/exporter). Orders are “FOB” Toronto, Ontario, Canada.
Any of the information we collect may be used in one of the following ways:
• To personalize your experience (your information helps us to better respond to your individual needs)
• To improve our website (we continually strive to improve our website offerings based on the information and feedback we receive from you)
• To improve customer service (your information can aid our efficiency and effectiveness as a service provider)
• To process transactions. Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company without your consent, other than for the expressed purpose of delivering the purchased product or requested service.
• To administer a contest, promotion, survey or other site feature
• To send periodic emails.

At MBartist we implement a variety of security measures to maintain the safety of your personal information. We use Secure Socket Layer (SSL) when collecting banking and credit card information. This information is encrypted and can only to be accessed by authorized personnel.
MBartist does not sell, trade, or transfer your personally identifiable information to outside parties. This does not include trusted third parties who assist in operating our website, conducting our business, or to help service you. Please be aware that and involved third parties are held to strict confidentiality protocol. However, we may release your information when we believe it is appropriate to comply with the law, enforce our site policies, or protect ours or other’s rights, property, or safety. With that said, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, etc.
Occasionally, at our discretion, we may include or offer third party products or services on our website. These third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content/activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.
Standard production lead times are as follows:
For in-stock items (Original Artwork, Limited Edition and Signed Works), orders ship in 3 – 5 working days from the order date.
For print-on-demand items (Archives), orders ship in 5 – 7 working days.
Deliveries to the United States are subject to custom clearance and border delays. The production lead times do not include transit time, custom clearance or border delays that are in addition to the shipping time previously noted. MBartist shall not be held responsible for delays in shipping time as a result of unforeseen circumstances or uncontrollable events including, but not limited to, border delays, custom clearance, third party labor disputes, natural disasters, civil strife, acts of terrorism and/or war.
Orders are subject to the availability of the products requested. All descriptions and illustrations of products, unless otherwise noted, are approximate and actual products may vary slightly from digital representation. While making every effort to accurately describe and represent the products online and in print, MBartist and our affiliates reserves the right to alter any hardware, presentation or packaging detail of products described. MBartist makes no warranty or representations regarding same and shall not be responsible for any direct, indirect, incidental, punitive or consequential damages or any other damages whatsoever, including without limitation, any loss of use, lost data, lost profits or lost opportunity, in an action for contract wit a third party, or in an action for negligence or tort otherwise. Production ink colors may vary slightly on repeat orders. While every effort is made to ensure that colors match as closely as possible, actual material colors and/or finish may vary slightly from those depicted on the MBartist website.
Payment of orders placed online are due on sale. MBartist offers two secure payment portals: PayPal and Chase Paymentech Gateway. Accepted credit cards include Visa, Mastercard and American Express.
